Thrive Mobility – Terms of Service

These Terms apply to every sale of goods and supply of services (“Goods” and “Services”) by Thrive Mobility (“Supplier”). By purchasing from us, you (“Customer”) agree to these Terms. Any terms put forward by the Customer that are inconsistent with these Terms will not apply unless we agree in writing. These Terms represent the entire agreement between the Supplier and the Customer.

1. Definitions

1.1 Australian Consumer Law (ACL): Schedule 2 to the Competition and Consumer Act 2010 (Cth), as amended.
1.2 Customer: The person or entity purchasing Goods and/or Services from Thrive Mobility.
1.3 Goods: Mobility aids, equipment, or other products supplied by Thrive Mobility.
1.4 Services: Any related services supplied by Thrive Mobility.
1.5 Supplier: Thrive Mobility ABN [insert ABN], operating via thrivemobility.au.
1.6 Terms: These Terms of Trade.

2. Pricing

Prices displayed on our website or in quotes include GST unless otherwise stated.

Prices may change without notice, but the agreed price at the time of purchase applies to your order.

3. Payment

Full payment is required at the time of order, unless Thrive Mobility agrees otherwise in writing.

We accept the payment methods displayed at checkout.

If a Customer has an approved credit account and payment is not made by the due date, Thrive Mobility may:

suspend or cancel future orders;

charge interest on overdue amounts at 2% above the prevailing overdraft rate of our bank; and

recover all costs of debt recovery (including legal fees and collection agency costs).

4. Delivery & Risk

Orders are subject to stock availability.

We deliver Australia-wide using recognised couriers. Delivery times are estimates only. Thrive Mobility is not liable for delays outside our control.

Risk in Goods passes to the Customer upon delivery.

Customers are encouraged to inspect Goods immediately upon receipt and notify us of any issues within 7 days.

5. Retention of Title

Thrive Mobility retains ownership of all Goods until payment is received in full.

Until full payment is made, the Customer:

holds the Goods as fiduciary bailee for Thrive Mobility;

must store Goods so they can be clearly identified as our property; and

must not sell, lease, or otherwise dispose of the Goods without our written consent.

6. Returns & Refunds

Returns are accepted in line with the Australian Consumer Law.

Customers are entitled to a repair, replacement, or refund if Goods are faulty, unsafe, not fit for purpose, or significantly different from their description.

Change-of-mind returns are not generally accepted unless agreed by Thrive Mobility at our discretion.

To arrange a return, please contact us first to obtain authorisation and return instructions.

7. Limitation of Liability

Nothing in these Terms excludes rights under the Australian Consumer Law.

To the extent permitted by law, Thrive Mobility’s liability is limited to:

repairing or replacing the Goods, or supplying equivalent Goods; or

refunding the cost of the Goods or Services.

Thrive Mobility is not liable for indirect, special, or consequential loss (including loss of profit or business opportunity).

8. Termination

Thrive Mobility may suspend or cancel supply if the Customer becomes insolvent, fails to make payments when due, or breaches these Terms.

9. Intellectual Property

All intellectual property in our website, logos, images, and marketing materials remains the property of Thrive Mobility. Customers must not copy or reproduce these without permission.

10. Governing Law

These Terms are governed by the laws of South Australia. Any disputes will be subject to the jurisdiction of the courts of South Australia.

11. Force Majeure

Thrive Mobility will not be liable for delays or failure to perform obligations due to events beyond our reasonable control (e.g. natural disasters, transport disruptions, or supplier delays).
